I have two Cisco nexus switches are connected together by VPC on 10 gigabit link , my question is is there any limitation on up-link speed ? for example can I use 40 gigabit up-link within VPC link is 10 gigabit link ?

If I understand you question correctly you have two Nexus with a 10G VPC peer link between them and want to know if you can have 40G uplinks from these switches to other devices. You can do this, but the important thing to determine is what are the traffic requirements?
If the network requires the 40G links, then the connection between the two switches may be a choke point so it would be wise to increase the bandwidth there too.

As Chrihussey said, There is a thumb rule that vpc domain link (between two nexus) should be always either 20 gig or 40 gig.
if you connect downstream devices with 40 gig, it is recommended to add vpc link as 40 gig or 80 gig between two nexus. this will not choke traffic
