7609 dot1q 1 native rejected

I am in the process of replaceing 7206VXR for a 7609 WS-SUP720-3B running Native IOS :c7600s72033-advipservicesk9-mz.122-33.SRC6

The issue I am having is when I try to add "encapsulation dot1q 1 native" to one of my sub-interface's, I get an error that states "Command rejected: VLAN1 cannot be allocated because it is the default vlan".

7206VXR Int Conf:

interface GigabitEthernet5/2
  no ip address
!
interface GigabitEthernet5/2.1
encapsulation dot1Q 1 native
ip address x.x.x.x
interface GigabitEthernet5/2.200
encapsulation dot1Q 200
ip address  x.x.x.x

!

7609 Int Conf:

Router(config)#interface GigabitEthernet5/2.1

Router(config-subif)#encapsulation dot1Q 1 native
Command rejected: VLAN 1 cannot be allocated because it is a default VLAN

You can't do this because of global vlans vs local vlans. Have a look at this thread which explains it -

instead of using subinterfaces can you not simply use a L3 vlan interface which is the standard way of doing it on L3 switches. And yes the 7600 is sold as a router but it and the 6500 are based on a similiar architecture.
