We have two ASA5540 in failover configuration; one of them some time
crashes with the error:
An internal error occurred. Specifically, a programming assertion was
violated. Copy the error message exactly as it appears, and get the
Message #96 : output of the show version command and the contents of the configu
ration
file. Then call your technical support representative.
Message #97 : assertion "new_flow->conn->conn_set == NULL" failed: file "snp_mca
st.c", line 649
: End_Crash
Could it be a software bug or a configuration problem ?

This is a bug not a configuration problem. I advise you a open a case with Cisco and send them the show tech output to troubleshoot this problem.
Moreover, what version of IOS are your running. Try running the latest one 7.2.2 has lots of bugs fixed.
