To close this out, the bug was fixed as CSCvu65604 in IOS-XE 16.12.55, 17.3.3, and 17.5.1.

I don't understand why you're involving RSPAN and not just using EPC by itself. That has worked for me on remote IOS-based routers.

It handles subnets fine but you have to use that syntax. Instead of "host subnet" you need "subnet subnet-mask". And from what you wrote about the purpose, I think you need to reverse the source/dest, assuming the ACL gets applied to the outside in...
