You were spot on. I was running GNS3 and after posting this had noticed this happening with a number of my 7200 IOS versions. Switch to a 3725 image and had this working without issue.
I was able to run it successfully on a 3640 router on GNS3 but had the error when running it on a "real" switch (3650).
I used EEM to allow me to remotely shut down and interface and have it automatically "un shut" after minute.

Tried that but the ASA drops the traffic according to this, i am guessing by the fact no acl is configured on the outside interface (which shouldn't be required)not seeing anything on the logs eithertraffic to all other tunneled subnets is fine.
