CSCvm87134 - Cat9K stackwise-virtual- Smart license registration status is lost after 2 to 3 multiple reloads/SSO - 1

I am running into this smart licensing bug (CSCvm87134) running one of the affect releases: cat9k_iosxe.16.10.01.SPA.bin on a Cat9500. 

The recommended version of code to resolve this issue is cat9k_iosxe.16.10.02.SPA.bin however i do not see this as a download option. Has this been release yet?

I opened a tac case and there is no cat9k_iosxe.16.10.02.SPA.bin 

The tac engineer recommended that I upgrade to 16.11.01. I am running virtual stackwise on a 9500-48y4C which requires at least 16.10.01 which is why i am not going down to the recommend version.
