ASA dropping normal traffic if failover link is down

Hello everyone, 
I have a strange one for you. We have two ASA in active/standby failover. Due to a 4500-x(our cores) Bug we had to take down the inside and failover link of the standby firewall. Once we did this we noticed about a 1-3% packet loss on our outbound traffic to the internet. 
Once we restored the failover / inside link on our standby firewall by moving it to our other 4500-x, the packet loss vanished. 

Has anyone experienced this behavior? When a standby failover link is down there is packet loss?

This could be a software or hardware issue. not heard anything if you have cisco support open a tac case.

Well two other people marked as having this issue as well. We did not open a cisco tac case on this.
