L3 communication between VSM and VEM is already supported  N1K , starting from AV release onwards, i.e 4.0.4SV1(2) onwards.Please refer the Nexus1000V configuration guide on L3 configuration details.

Can you post the running configuration. There are multiple reasons why the port could be down. Policies applied on the port might be getting rejected during the port bring up , Vlan not being active internally.

This is internal error message from ACL susbsystem (Internal ACL Database got into some inconsistent State).  When are you hitting this problem, is it during addition/deletion of the acl.Could you dump the running configuration, and provide interface...
