When policing or shaping, is the average rate variable akin to frame relay's CIR? That's the way it seems to me, but i still get confused by some of the terminology.Also, why does policing use bytes for the burst and excess while shaping uses bits?

no, LSA type isn't figured in. Assumig prefix length is the same, only cost matters. alter the metric at the redistribution point to setup which one you want to be preferred.
