the bug was related to pizza guy feature for a non domain contact add; though if you are trying to add a contact which is in the same LDAP domain like yours; even though you donot enable presence you shoudl be able to add it as a contact; however the presence information will not work and you will not be able to chat with this user as this user would not be logged in to jabber.
i validated this over a recreate with the following s/ws:
-> cups version 8.6.x
-> J4W version 9.2.5
-> MS Ad version 2008 R2.
