an update it turns out that the ability to add access-lists directly to the inbuilt switch ports, (Its a active layer 3 device) is no longer their in the later releases of software, confirmed by TACMaybe one day the function will return
So just as an update it turns out that the issue was with Cisco ISE and a patch has been released to resolve this. (Patch 6)I will be implementing the patch shortly and will get back with the results and then maybe look at going to 7a..
