Access Point dynamic data rate

I am not sure if this is the right forum to ask this question. I am not the expert in WLAN system, but I need to find an AP for a test. Basically I need an AP so that I can fix the data rate to one value(for example 54Mbps) and test our client device which is a handheld mobile VOIP device. My test is to find out the operating distance at different data rates. My colleage who is more experience in system level told me that the Cisco 1240 AP cannot fix the data rate to one value even though all other data rates are disabled.  He observed several times that the disabled data rates were used by the AP.

Did anyone observe this phenomenon? I know at probe request and Ack the lowest data rate is used, but other than that the AP should stick to the supported data rates only.  We have not spent too much time to test other AP.
