Disclaimer text in rich text format mails

We have defined an incoming filter that add a disclaimer text for a external emails. This disclaimer text are configured for both options available: plain text and HTML format. 

However we have a problem. If we receive an email in rich text, this disclaimers are not put in the message body. this disclaimer are add as file attachments. This is a problems because the "warning" for our users is not easy visible.

Please, could you help us how to add a disclaimer text in rich format?

General suspicion would be due to different encoding between the message body and the disclaimer. You can try to tweak the localeconfig on ESA to overcome this behaviour.
