1. TE6 is targeted for release to Cisco.com in late November.
2. TE6 will follow the same entitlement model for the software as the Cisco IP Phones. So you will not need a support contract on the EX endpoint, but I believe you will need an active support contract on your CUCM to access the software. The node lock mechanisim (release key) will not be present in TE6 as it is a CUCM only release.
FYI, TC6 for EX will continue to require a support contract and maintain the existing node lock (release key) requirements.
