If its a new buy out it depends on the mode of purchase either directly thru Cisco approved partners or thru some third party.
In most of the cases if ur going thru geninune Cisco approved partners you will get the original IOS code loaded onto that.
yes ofcourse you will be billed for the same thats for the other feature set which doesnt come by default with the sale.
