CBR, VBR, 2PASSVBR on MXE3500

Does anybody know why if I set a maximun bitrate for all VBR modes on h264 encoder, then I transcode a video, and then analize this video with tools like bitrate viewer... and the maximun bitrate is over the one I set on the MXE? And also, in the CBR mode you should set the average bit rate, is this CVBR mode instead of CBR mode?

Here the answer:

"The relationship between the average bit rate and the peak bit rate is often misunderstood. The peak bit rate describes a buffer constraint over a period of time specified by the peak buffer window. The average bit rate for two-pass VBR (unconstrained or peak-constrained) is the average bits per second over the duration of the file."
