On a 3750 with C3750-IPSERVICESK9-M), Version 12.2(55)SE5, RELEASE SOFTWARE (fc1) getting the following message :
%ILPOWER-3-CONTROLLER_PORT_ERR: Controller port error, Interface Fa5/0/33: Power Controller reports power Imax error detected - what is causing this ? is there a software bug ?
what can bve done to resolve this ?

Could be. Upgrade to 12.2(55)SE10 and see if it improves.

Hi!
You could be either hitting this bug or a problem with your PDs not receiving enough power.
In any case you should upgrade to any of the known fixed releases:

As workaround please use the switch(config-if)#power inline static command, this guarantees that PDs will get enough power when connected.
