IOS upgrade Failures on 9606

I am having some weird issues when trying to upgrade my 9606 Switches from cat9k_iosxe_17.08.01 to 17.09.03

We are running two 9606 in Quad-Supervisor in RPR mode. 

we are able to install the file via TFTP just fine.

When we install add file flash: activate commit it will go through the process and ultimately fail.

( example below)

trying to remove the install with - install remove inactive shows all files that will be deleted ( the unpacked 17.09.03 files as well as a few of the 17.08.01 files) the last line before the Y/N prompted show up

[1] Chassis 1/R1 FAILED: Software internal error - General error,EINVAL - Invalid argument

selecting yes returns FAILED: install_remove.

At this point the only way to remove the unpacked packages is to force the supervisor modules to fail over with the "redundancy force-switchover"

at which point you can install remove inactive before the supervisors link up.

Below is our "show install summary" 

which shows 1/R0 active and uncommitted on the 17.08.01 odd

I have looked at the install guides for 17.09. and we have tried everything listed besides formatting flash, and disconnecting the SVL's .

we have upgrade several times before with starting at base to 17.5, 17.6, 17.7 

any help would be appreciated
