upgrade from SXI to SXJ, smartnet required?

Hopefully someone can help me out with this quick one. I have a customer that wants to upgrade a sup32 from 12.2(33)SXI3 to 12.2(33)SXJ. They get some extra OSPF out of it according to the feature comparison tool that they want.

They dont have smartnet, are they allowed to make this jump without paying for an upgrade? If they need to upgrade do they need to pay? Same versions, same IP Base SSH feature set.

Normally if you are downloading the same feature set then you don't need to pay BUT you still need SmartNet.

I suggest contacting the TAC so they can send a temporary FTP link to download the file.
