Team - We are going for a refresh of the Anchor WLC. Current one is 4402 which is used only for guest user connections, there are no AP registered on it. We would be replacing it with 5508 but this time in HA.
Q. Do we really have to go for AIR-CT5508-HA-K9. Cant we just purchase 2 qty of AIR-CT5508-12-K9 .
Please advise.

It does not work with zero licenses, however it can work temporary with the evaluation license. So if you order two C1 5508s you need to have at least one AP license for it to work with HA-SSO in a permanent setup.

The story with HA-SSO on 5508 controllers with traditional licensing is that the secondary HA-SSO controller should have at least 50 AP licenses or it needs to be the special HA SKU. But...
The cheaper solution in this case is to buy a 5508 controller without any licenses which are build for the Cisco ONE licensing model. You need to use the C1-

So does that mean, without any AP licenses built in and no HA sku, we could still be good if we use a C1-AIR-CT5508-K9. As even in C1 SKU, I am not going to choose any C1 license ( Foundation / Advanced ). Would the HA still work ?

Good question, I have never built this setup with two C1 controllers without any licenses at all. I know that you are good to go as long as you have one permanent AP license on the primary.
Later on this week I will deploy a new set of C1 controllers in HA-SSO, so if you really want to know if it works with zero licenses let me know 🙂
