Is protocol icmp is in internet layer ???

The question is
how we use ping with ip
and we know that
Ip and icma protocols is in the same layer ???

it L3 protocol, 
and any L3 protocol can use IP to connect. 
the protocol if it L3 that not meaning that it can not use IP.
