Need to know if I need to enable QOS on the swithcport that the phone is connected to or can I just use the MLS command?

It depends, if your Avaya phone uses DSCP settings for things like SIP signalling and RTP (af41 and or ef).
You can simply put a trust statement on your access port and pass it on.

sure does, If you set the access port to trust these IP presedence values, then you have to make absolutely sure that your phone sends the correct cos values.
