Hi ,
I need some advice on the configuration for the voice vlan configuration for softphones.
My issue is that the softphones are getting the IP address from the data vlan and not the voice vlan.

Softphones will not get a Voice VLAN as it runs on the PC and uses the PC's NIC card for communication. As best practice you can trust the sofphone in your QoS configuration, refer to the QoS SRND

The softphone (and IP Communicator) are using your PC's IP address. You can not give them another IP address. For the IP Communicator you have to add the MAC address of your PC's NIC card.
