We have a new pair of Nexus 9372 switches and was wondering the best way to connect them to a pair of 6800 in a VSS configuration
We have a pair of 5596 connect to another pair of 6509 in another data centre so I am more familar with those.
For the 9372 do we just connect them to the VSS pair by a MEC like our 5596 switches and let the VSS do the routing? Or do we do layer 3 on both the Nexus 9372 and VSS switches connected by a port channel?
Attached is a diagram showing two options. Any suggestion would be appreciated.

Yes, layer-3 Portchannel (fully meshed) will work fine.

Do you still need a VPC link between the 9372 switches like on the 5596 switches.
I have been going over the documents but it isn't clear.

In NXOS mode (standalone mode) you need the vPC peer-link.
