A customer is insistent on only ordering a DNA-E bundle ( C9410R-96U-BNDL-E ) of a C9400 and adding a 2nd SUP as a spare, even though I point out that high availability is specific to DNA-A in the datasheet/ordering guide. https://www.cisco.com/c/en/us/products/collateral/switches/catalyst-9400-series-switches/nb-06-cat9400-swit-ser-cte-en.html
What will happen when they install the 2nd SUP? Will it work fine except failover? Will it work fine except for testing new IOS? will it go 'out of compliance' and not allow changes after 90 days? Will it work just fine?

It will work just fine as long as the 2 sups are configured as SSO.

Thank you, I just want to be clear:
So 'mode sso' that enables high availability won't have an issue with smart-licensing seeing only DNA-E when the ordering guide says you need DNA-A for High Availability?:
High availability and resiliency (patching)
Support operational continuity and maintain availability during routine maintenance, and perform disaster recovery.

As long you run "Mode SSO", and you have the same license level on both sups, you should be good to go. The output below is from a 9410-R with 2 sups.
Technology Package License Information:
-----------------------------------------------------------------
Technology-package Technology-package
Current Type Next reboot
------------------------------------------------------------------
network-essentials Permanent network-essentials
dna-essentials Subscription dna-essentials

What specific version?
All platforms running IOS-XE are affected. Let that sink in for a moment: All platforms. All versions.
Either upgrade the firmware to the known fixed version or perform the workaround. Do not leave this unattended because it will memory leak (control-plane) until it crashes.
