Hi,
A software upgrade may remedy the issue. I would start with that.

Hi Reza, many Thanks for your Reply! which Version is your recommendation?
in Customers Environment we have running 2 exactly identical cisco Nexus 5596 Chassis with N5K-C5596UP-SUP and Version 5.1(3)N2(1b) and same uptime since reload . only one of them get this behavior with faulty Interfaces. best regards Mike

Hi Mike,
It is hard to tell what feature sets you may need. Looking at Cisco's site, the recommended version for 5596UP is:
Cisco Nexus 5000 Series Switches 7.1(4)N1(1) for both systems and kick start
That said, I would read the release notes very carefully before loading any version to make sure you are aware of the features and caveats the version is providing.
