WDS with different networks

Should the WDS be able to see AP across different networks ( different vlans )? I have 40 or so on one WDS with all the same network. I have added 3 new ones on a different network and they don't see the WDS. WLSE can see them just fine and they are pingable and working just fine.

Nope, you need one WDS per subnet, unless you want to spring for the WLSM module for a Cat 6500.

Even if I have a WLSE in the backround?

The WLSE is not a WDS. You need a WDS on each subnet; the only way the WLSM gets past this is by establishing a GRE tunnel to each AP so that it can pretend it's on the same subnet with all of them.
