We are running a 4400 - Version 4.2.176 for our guest network.
My question is Does the Web authentication/Login page have to
be secure https? Can it be http?

I just tested that in my lab and you need to enable http and disable https on the management http-https configuration tab. I had to reboot the WLC in order for it to work, but that might be because I also regenerated the certificate.

I would say it is possible, I found an idea here:

If you have HTTPS enabled on the controller the webauth login page should use SSL. Just go under Management - HTTP and make sure you have HTTPS enabled. If you don't have it enable the webauth page would not be encrypted.

maybe my mistake, do you have http also enabled?
my post was just an example for the other case, to just https in case of http..
