Is there anyway of customizing the login.html so that the aup.html of the WLC guest authentication displays the local language of the web browser or to detect the users IP and trigger the correct language.
Or possible I could create some flag icons and then direct users to the correct aup.html file. but ideally i would like the process to be automatic.
Any ideas?

Not possible unless you have a good developer who knows how to do that. You could always redirect the splash page to an external server.

Not in the WLC per say, as mention by Scott you will nedd good develover or an external server.....
Another option will be using Cisco ISE (Identity Service Engine newer release 1.1 higher) that supports multilanguage change on the Web Auth/CWA splash pages
