i have a cisco phone 7970 that when connected a switch with access vlan and a voice vlan configured , it will only pick the access vlan , even when i remove the access vlan and leave the voice vlan it wont pick that vlan like it isn't a phone? only solution is to make the voice vlan as a access vlan for it to work properly? how can i solve it?

Can you swap this phone with any other switch port where an IP phone is connected and working fine. Check if the issue is following the phone or the switchport.

tried so , same issue with the phone not detecting voice vlan only access vlan

If other phones can get the voice vlan when connected to this switchport then it looks to be an issue on the phone itself, you may try a factory reset if only one phone is affected.

already did that getting an error during upgrade , most likely because it cant find the cucm on access vlan

For factory reset it should be connected to a known working port with dhcp enabled and should be able to reach the correct TFTP server.
