Hi all thanks in advance,
First of all, I'm really new to cisco. But I'm depreciating our old fax server that uses perle modem cards. I'm using t38modem software. I have a h323 endpoint setup on CUCM that has no problem receiving calls and faxes however when trying outbound it gets a busy tone. Any ideas?

Are you able to make outgoing calls from the H.323 end point ? If yes and only fax failing, i assume you send fax to ISP with protocol which they are not compatible.
Are you sure that the ISP use t38 for FAX ?
Secondly what is this h.323 device, is it VG or a gateway ? Can you explain a little more about your setup ?

I appreciate your reply I haven't tested h323 as a phone cause this is purely a software-based setup. But I am going to try later today. This isn't a VG or a gateway, it's acting as a phone as CUCM marked it. In our environment, we do have h323 gateways and a VG310 (for the analog translation to the physical fax machines and cards). Let me know if this makes sense thanks!
