Quick QoS question

So, I've got an MPLS provider that is prioritizing traffic and limiting bandwith on a 100Mbit connection.  We've got to mark traffic using dscp designations and ACL's.  We have 4 buckets.  Real time (35%), Gold (25%), Silver (15%), and Default (remaining 25%). 

Here's the scenario.  Bandwidth utilization is at 100%.  All buckets are full.  Silver is filling its own bucket plus the default class.  My questions are as follows:

1.  If we have two systems filling the Silver (15%) bucket and the remaining default class, which system gets priority?  Is it FIFO?

2.  If we have two systems in Gold (25%), and they're filling the Gold bucket and begin to transmit more than 25Mbit:
     a.  Will it be FIFO for both systems?

     b.  Will Gold traffic begin to stomp on Silver traffic?

If QoS is provided/implemented by your MPLS provider, they're the ones you need to ask.  (Different platforms often implement QoS differently.)

BTW, you may need to have a NDA with your provider for they to reveal how they really will treat your traffic when there's congestion.

Let's assume for the sake of argument that they're using prioritize statements on 2951 routers.
