Avoiding IP conflict ...

[1] I would like to know how can I proactively avoid IP conflicts in a network. This is becuase there was a customer that set a static IP that was actully a gateway IP and the whole IP subnet became unstable as the clients did not sent the route to the actual gateway.

[2] Would the router be able to detect that a new host is using an IP that is

already in use by inspecting the arp table first ?

You can use Dynamic ARP inspection if it is supported on your switches (3550/3560/3750/4500/6500). There is a table of valid IP to MAC mapping and all ARP responses are inspected.
