Hello there,
imagine Two geographically split CUBE routers (non box2box HA) each cube on its own at a separate location connected to a single ITSP with the same sip trunk at each location. Session count is 200 and this is cross site.
IOS XE is 16.12 which does not support dynamic session count for smart account license reporting. Now how many license capacity should customer specify on their cube in mode border-element capacity? should it be mode border-element capacity 200 at each location ? In this case smart account SSM shows license over use as it displays as 400. Should they split 100 and 100 at each location? But in this case if location one is down then the other one should take all 200 sessions. Will the cube with mode border-element capacity 100 configured take 200 sessions?

If 200 is the total amount you want from both SBCs combined you should put 100 in each. Also please note that whatever you put there it will not actually limit the number of calls to that number, you can have n+1 and more calls in each SBC. This number is only there for license purposes. You can actually set it to 1 if you want to and it would have no effect on calls. It would only affect what the gateway requests from the SL system. Might I ask for what reason is an upgrade of IOS out of the picture? The version you are on is quite old. Many in the community have standardised on version 17.6.4 as that’s currently a stable version that has support for many of the new features there is. For example we use this version on our +140 voice gateways that are a mix of traditional TDM connections, ISDN and R2, and on SBC type of connections, ie SIP circuits to the service provider. On all of these we use SIP as the communication protocol towards CM.

If you want to have 200 calls per site you’d need to have 200 sessions per SBC. So you’d need to have 400 in total. The option would be to upgrade to a IOS version that supports pooling.

Sorry I meant 200 cross site. IOS XE upgrade is not an option.
