harware qos is it only when congested?

whey I apply qos settings to the hardware queues in say a 3650 or 6500, are they used all the time, i.e is voice always sent first in the priority queue or is it only when port is congested like in llc or cbwfq?

It is when the port or link gets congested.

And what should I do if link will never be congested? For example we have several 10Mbps links agregated on 6500 using 100MBps ports.
