CAPWAP encryption using DTLS via internet

may be it's stupid question, but can't clever understand how to WLC "is smart enough" to enabling automatic CAPWAP encryption using DTLS in case while AP (not configured, so it is in local ap mode by default) joined from internet?

I don't really understand your question.  The DTLS is a feature configuration for the data plane that is enabled or disabled.  The AP first needs to join to get its configuration, one being if this setting is enabled or not.  Remember, its a setting you set and is only fully functioning after the ap joins.
